Terms & Conditions

These Terms & Conditions ("Terms") are an agreement between you and Digital Park LLC ("Paybunny", "we", "us") for your use of the Paybunny app and https://www.paybunny.ai (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Paybunny.

Please read the section "Disputes and arbitration": it affects how disputes are resolved.

Who can use Paybunny

You must be at least 18 years old, live in the United States, and be able to form a binding contract. You're responsible for keeping your phone and account secure and for everything that happens under your account. Tell us right away at office@digitalpark.studio if you think someone has accessed your account.

What Paybunny does

Paybunny helps couples see their money together: balances, spending, bills and expenses, budgets and savings goals, with insights and an AI assistant.

Paybunny is an information tool. We don't move money, hold funds, make payments, or open accounts for you. We're not a bank, lender, broker, tax preparer or investment adviser.

Couples and sharing

Paybunny is designed for two people. When you invite your partner and they join, you agree that each of you can see the accounts either of you links (with balances and transactions), and the expenses, budgets, goals and other information either of you adds. Only link accounts you're comfortable sharing, and only accounts you own or are authorized to access.

Only the person who linked an account can remove it.

If you decide to split your finances, either of you can delete your account in the app's settings. Please note before you do: deleting your account can't be undone. The accounts you linked and their transactions are removed and disconnected, but the expenses, budgets and goals you shared stay with your partner, and anything they already saw can't be taken back.

Linking your accounts with Plaid

We use Plaid Inc. ("Plaid") to connect your financial accounts. By linking an account, you authorize Paybunny and Plaid to access and use information from your financial institutions to provide the Service, and you agree to Plaid's End User Privacy Policy (https://plaid.com/legal/#end-user-privacy-policy). You grant us and Plaid the right to act on your behalf to access and transmit that information, as described in our Privacy Policy.

Account information comes from your financial institutions through Plaid. It can be delayed, incomplete or occasionally wrong, and we're not responsible for errors in it. Always check important information with your financial institution.

Not financial advice

Everything in Paybunny, including insights, summaries and answers from Ask Paybunny, is for general information only. It is not financial, investment, tax, legal or credit advice, and it isn't a recommendation to buy, sell or do anything. Paybunny's AI can make mistakes. Decisions about your money are yours; for advice, talk to a licensed professional.

Free plan and Paybunny Plus

Paybunny is free to use, with 3 questions a week in Ask Paybunny for each partner. Paybunny Plus is an optional subscription that gives each partner 40 questions a month (they reset on the 1st of each month and don't roll over), plus weekly, monthly and yearly summaries. One subscription covers both partners in a couple.

  • Price: shown in the app before you buy (currently $5.00 a month or $49.99 a year, plus any applicable tax).
  • Renewal: subscriptions renew automatically at the end of each period until you cancel.
  • Cancelling: cancel at any time in Profile, Subscription, Manage subscription (the partner who subscribed manages it). Cancelling stops the next renewal; you keep Plus until the end of the period you've paid for.
  • Refunds: purchases through Apple or Google are handled under their refund policies. For web purchases, payments are non-refundable except where the law requires.
  • Price changes: we'll tell you in advance, and a new price applies from your next renewal.
  • Personal use: Plus is for your own household. We may limit automated or abusive use to protect the Service.
  • Changes to allowances: we may change the number of questions included, and we'll tell you in advance; a change applies from your next renewal.

Your content

You own what you add to Paybunny, like expenses, budgets, goals, notes and your questions. You give us permission to store, process and display it as needed to provide the Service to you and your partner, including sending it to our service providers as described in our Privacy Policy.

Acceptable use

Please don't:

  • Link accounts you don't own or aren't authorized to access, or use someone else's identity.
  • Use Paybunny for anything illegal, fraudulent or harmful.
  • Try to access other people's data, or interfere with or disrupt the Service.
  • Reverse engineer, scrape or copy the Service, or use bots or automated means to access it, except as the law allows.
  • Use Ask Paybunny to generate content that's unlawful, harassing or abusive.
  • Resell or offer the Service to others.

Our service and intellectual property

Paybunny, its design, software, name and logo belong to Digital Park LLC and its licensors. We give you a personal, non-transferable, revocable license to use the app for your own use under these Terms. If you send us feedback or ideas, we may use them without any obligation to you.

We keep improving Paybunny, so features may change, and some may be added or removed. We may suspend the Service for maintenance or for reasons outside our control.

Third-party services

Paybunny relies on third parties, including Plaid, your financial institutions, Apple, Google and our other service providers. Their services are governed by their own terms, and we're not responsible for them or for their availability.

Ending your account

You can delete your account in the app at any time. If you pay for Paybunny Plus, deleting your account cancels it: if your partner still uses Paybunny they keep Plus until the end of the period you paid for, and you aren't charged again. We may suspend or close your account if you break these Terms, if we're required to by law, or to protect Paybunny or its users. If we close your account for a reason other than a breach of these Terms, we'll refund any unused prepaid subscription for web purchases. Sections that by their nature should survive (like ownership, disclaimers, limits of liability and disputes) continue after your account ends.

Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the Service will be uninterrupted, error-free or completely secure, or that information in it (including from your financial institutions or our AI) will be accurate or complete.

Limitation of liability

To the fullest extent the law allows, Digital Park LLC and its members, employees and service providers won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or savings, arising from your use of the Service, even if we were told they were possible. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or $50.

Some states don't allow some of these limits, so they may not all apply to you.

Indemnity

If you break these Terms or the law, or misuse the Service (for example, by linking accounts you aren't authorized to access), you agree to cover the reasonable costs, losses and claims that result for Digital Park LLC, including reasonable legal fees.

Disputes and arbitration

If you have a concern, please email office@digitalpark.studio first; most issues can be solved quickly.

If we can't resolve it within 60 days, you and we agree to resolve any dispute through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court, except that either of us may bring an individual claim in small claims court. You and we waive the right to a jury trial and to take part in a class action or class arbitration.

You can opt out of this arbitration agreement by emailing office@digitalpark.studio within 30 days of first accepting these Terms, with your name, phone number and a clear statement that you're opting out.

Governing law

These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules. Where a court case is allowed, it will be brought in the state or federal courts in Delaware, unless the law of your state requires otherwise.

Changes to these Terms

We may update these Terms. If a change is material, we'll tell you in the app or by email before it takes effect. If you keep using Paybunny after that, you accept the updated Terms; if you don't agree, you can delete your account.

General

These Terms and our Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest still applies. If we don't enforce a provision, that isn't a waiver. You may not transfer these Terms; we may transfer them as part of a merger, acquisition or sale of assets.

For iOS users: these Terms are between you and Digital Park LLC, not Apple. Apple isn't responsible for the app or its content, has no obligation to provide support for it, and is a third-party beneficiary of these Terms.
